THIS AGREEMENT, between Ashley McKovich of Velvet & Vine Boudoir, (hereafter referred to as “PHOTOGRAPHER”), and you the client, (hereafter referred to as “CLIENT”), provides as follows:
1. Scope of Work
This contract is for photography services related to a boudoir photo shoot to take place at the above date and time. The shoot will take place at 808 Hillcrest Dr. High Point, NC 27265. Hair and makeup will be done at the same location unless otherwise specified.

PHOTOGRAPHER allows 1.25 hours for hair & makeup and 2 hours for the photo shoot, and agrees to photograph CLIENT and provide CLIENT with 50+ images for review from which to choose final images for products (albums, wall art, and digital files) that are sold separately.

2. Fees

For PHOTOGRAPHER’S services, CLIENT shall initially pay a non-refundable retainer fee of $249, which does not cover any images or image products, and must be paid in full at the time of booking, with a signed copy of this Agreement. The Retainer Fee reserves the appointment and services specified above, and goes toward covering the costs of producing a photoshoot, like professional hair and makeup, etc. It does not include any images, digital or print, or any other image products. The required minimum purchase is the $699 10 image album. In-house payment plans are not available for $699 collection.

If CLIENT cancels the photo shoot for any reason within 60 days of the appointed time, or fails to show up for the appointment, the $150 deposit will not be refunded to CLIENT, but used to pay cancellation fees of the hair & makeup artist and PHOTOGRAPHER, and to pay related studio costs. Nevertheless, CLIENT may reschedule the photo shoot prior to the 60 day deadline by securing another appointment time within 60 days of that specified above and subject to the same terms thereof.

All print credits must be used within 6 months of shoot date. After that date, they expire.
I understand the fees associated with this experience, and that I am responsible for the required minimum purchase of $699. Please initial below.
3. Fees Concerning Image Products

CLIENT will have the opportunity to view images in a live viewing session with the PHOTOGRAPHER either in person, or via ZOOM, if in-person is not an option, approximately two weeks after the photo shoot, or as otherwise agreed upon by both parties. CLIENT understands that none of the image products (such as albums, wall art, and digital files) are covered by the Retainer Fee. Rather, they are sold separately, and must be paid in full (including tax and any applicable shipping fees) before the order is processed. If purchasing a digital file collection, CLIENT will receive high-resolution jpg files. PHOTOGRAPHER does not release RAW image files for any reason. Client further understands and agrees that all sales are final, and that PHOTOGRAPHER will delete CLIENT’S unpurchased images from digital storage after the ordering appointment.

You will make your purchasing decisions the day of your ordering appointment. We accept credit cards and also offer in-house payment plans. If you decide to do an in house payment plan, you must put down 1/3 of your order total at the ordering appointment to quality for an in house payment plan. There is a 5% service fee with an in house payment plan. Most of my clients have found it helpful to open up a 12 month no interest credit card for their boudoir investment. This way, you can finance more for longer without interest. The Longest term of payment plan is 6 months, and the minimum monthly payment is $250. Products are only delivered after payment plan is paid in full. Due to the digital and custom nature of our work, ALL SALES ARE FINAL. Pricing subject to change without notice.

  1. Cancellation and Reschedule Policy

PHOTOGRAPHER agrees to reserve and not make any other reservations or accept any other clients for the date and time specified above. For this reason, cancellations and rescheduling are strongly discouraged. Any reschedule or cancellation requested within 30 days of the originally scheduled date will incur and $150 reschedule fee. Requests made with fewer than 14 days’ notice will be treated as a cancellation, and a new retainer, at full price, will be required to book another date. No-shows or same-day cancellations forfeit all payments made.

4. Hair and Makeup
CLIENT must inform the hair & makeup artist of any known allergies or adverse reactions to products and will hold them and PHOTOGRAPHER harmless from any adverse effects from hair & makeup products applied in a proper and normal manner.
5. Alteration of Finished Images
In order to protect PHOTOGRAPHER’S artistic style and reputation, CLIENT shall not duplicate, alter, edit, filter, crop, or change in any way the finished look of images received from PHOTOGRAPHER.
6. Copyright and Use of Images :
CLIENT agrees not to trade, sell, or license any image from the photo shoot to a third party without written permission from PHOTOGRAPHER, which may include a commercial usage license agreement. In accordance with copyright laws, PHOTOGRAPHER retains copyrights to any and all images taken. CLIENT may, however, display images on personal websites, social media, and physical portfolios, but only in finished form as received from PHOTOGRAPHER, with the only alteration being the images’ overall size appropriate for display. PHOTOGRAPHER requests all images displayed on social media be given photo credit to Velvet & Vine Boudoir.
7. Privacy, Confidentiality and Liability :
PHOTOGRAPHER will not display any image from CLIENT’S photo shoot anywhere, including any website, social media platform, or other medium, without first receiving CLIENT’S signed release through electronic or other means chosen by PHOTOGRAPHER. No provision of this Agreement constitutes such a release. Permission to share images will be given AFTER you have seen your images, and you will approve exactly which images are allowed to be shared, if any. You are under NO obligation to share your images.

CLIENT understands that it is their responsibility to inform photographer of comfort level as far as posing, wardrobe, and photoshoot style. All poses, and wardrobe choices are done by CLIENT'S own free will.

8. Photoshoot Conditions and Code of Conduct:
CLIENT represents being at least 18 years old, and recognizes that PHOTOGRAPHER does not photograph any person under the age of 18 in a boudoir style. CLIENT understands that arriving late to her appointed time will take away from the total amount of time allotted to her photo shoot. Additional time may be added to the end of CLIENT’S original appointed time slot if studio time is available, but CLIENT may be required to pay for additional studio time before shooting begins. If CLIENT is more than 30 min late, the shoot may have to be rescheduled at the discretion of PHOTOGRAPHER. CLIENT may not bring any family member, other person, or pet to the photo shoot. CLIENT understands that PHOTOGRAPHER has the right to cancel the photo shoot without refund of the Retainer Fee if CLIENT arrives at the photo shoot intoxicated or under the influence of drugs, as determined in the reasonable exercise of PHOTOGRAPHER’S discretion.
8. Force Majeure:
If PHOTOGRAPHER is unable to perform hereunder due to an emergency or any cause outside their control, they will refund the Session Fee in full, or, upon CLIENT’S request, reschedule the photo shoot.
9. Whole Agreement
This instrument reflects the entire agreement between the parties hereto with respect to the subject matter hereof and is not to be amended or modified except by an instrument in writing signed by each party.
